Purchase Contract

This Puppy Purchase Agreement ("Purchase Agreement") is made effective as of ____________, by and between Sean & Shawnda Pew, owners of Double S Blockheads ("Breeder"), and [Insert Buyer's Name] ("Buyer").

1. Purchase Details:

  1. Total Purchase Price: $____________

  3. Remaining Balance: $_____________ (due before the puppy is shipped or ownership is transferred from Breeder to Buyer)
    1. Payment for the balance can be paid via the following methods:

      • Cash

 

2. Health Certificates and Guarantees:

  1. Health Certificate:  The Breeder guarantees that at the time of delivery, the puppy will have a current health certificate from a licensed veterinarian confirming the puppy's health.
  2. Health Guarantee:  
    1. The Breeder provides a 1-year health guarantee against genetic disorders that are life-altering.
    2. Exclusions: This guarantee does not cover any health issues that arise due to accidents, neglect, or conditions developed from the Buyer's environment after the puppy leaves the Breeder's premises, including but not limited to:
      1. Injuries and accidents.
      2. Infectious diseases contracted after leaving the Breeder’s property, including but not limited to Parvovirus and Coccidia, which are often related to environmental factors and exposure after leaving the Breeder’s care.
      3. Conditions related to environmental factors, such as allergies or mold.
      4. Problems associated with improper feeding or care.

 

3. Remedies Under Health Guarantee:

3.1 If the puppy is diagnosed with a genetic disorder within the specified guarantee period, the Buyer has the option to return the puppy and all necessary registration transfer documentation, to the Breeder for a full refund of the purchase price, or

3.2 The Buyer may choose to keep the puppy, in which case the Breeder will refund 50% of the purchase price to help cover any treatment costs, provided that:

  1. The Buyer supplies a written diagnosis from a licensed veterinarian.
  2. The diagnosis is confirmed by a veterinarian chosen by the Breeder, at the Breeder's expense, if the option is exercised.
  3. The puppy is spayed or neutered to prevent passing on such genetic disorders.
  4. The Breeder reserves the right to request a second opinion on any diagnosis at their expense before issuing any refunds.
  5. All claims under this health guarantee must be made within 48 hours of the veterinary diagnosis.
  6. Funds will be returned to Buyer via the same transmission methos as they were received upon confirmation of spay or neuter procedur

 

4. Registration and Documentation:

  1. Registries: The Breeder guarantees that registration documents for the following registries:

  2. The Buyer acknowledges that registration of the puppy, including all associated costs, is the Buyer's responsibility.

 

5. Additional Services and Charges:

  1. The puppy will be delivered dewormed with two sets of shots, dew claws removed, and tails docked (if applicable) at no cost to the Buyer.
  2. Optional Ear Cropping: This service is optional, and the charges are not included in the purchase price of the puppy.  The procedure, if selected, will be performed on or around the 6-week mark and at Eartrim.com in Spring, Texas.  The buyer must pay for the procedure either directly to Eartrim.com or the Breeder PRIOR TO OR ON THE DAY OF THE PROCEDURE.  Pricing for the procedure can be found on www.eartrim.com or will be provided to you by the Breeder. A charge of $100.00 will be due to Breeder for two-week aftercare following the procedure.

 

6. Puppy Pickup and Whelping Fees:

  1. Scheduled Pickup: The Buyer agrees to take delivery of the puppy no later than 9 weeks of age unless a different arrangement is mutually agreed upon in writing by both the Breeder and the Buyer.
  2. Late Pickup Fees: If the Buyer fails to pick up the puppy by the end of the 9th week, a whelping fee of $30 per day will be charged for each day the puppy remains with the Breeder beyond the agreed pickup date.
  3. Forfeiture of Rights: If the puppy is not picked up by the end of the 10th week, and no prior arrangement for a delayed pickup has been agreed to by both parties, all payments made by the Buyer will be forfeited. The Breeder reserves the right to sell the puppy to the next qualified buyer without any obligation to refund any payments received from the original Buyer.

  1. Governing Law: This Agreement and any disputes arising from or related to this Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any choice or conflict of law provision or rule.
