Puppy Deposit Agreement

(THIS IS FOR REVIEW ONLY. BREEDER WILL COMPLETE WITH YOUR DETAILS AND EMAIL FOR DUAL PARTY SIGNATURE.)

This Agreement (“Deposit Agreement”), dated as of ______________________ , 20____ (the “Effective Date”), is between Sean & Shawnda Pew, owners of Double S Blockheads (“Breeder”) and ___________________________ (“Buyer”). Buyer agrees to place a $_________  deposit (the “Deposit”) on a __________________________ puppy from Breeder. The final amount due is $_________.

The total price for the puppy is $_________, to be paid in full before the puppy leaves the Breeder’s possession.

1. Non-refundable Deposit: Buyer acknowledges that the deposit is non-refundable, except as specified in the Conditions for Deposit Refund (Section 2). Upon receiving the deposit, the Breeder agrees to reserve the puppy for the Buyer until it is weaned and ready for pickup. All payments under this agreement must be made in US dollars to the Breeder.

Deposits can be paid via the following methods:

   2. Venmo: @DoubleSBlockheads
   3. Cash

2. Buyer Acknowledgments: Buyer acknowledges and agrees that:

1. Breeder cannot predict litter sizes and wait times for puppies may extend beyond initial expectations.
2. The deposit secures a placement for selection, determined by the sequence of received deposits, but does not guarantee the availability of a puppy matching the Buyer's preferences when their turn arrives.
3. Selection order is based on a first-come, first-served basis, and the Buyer's position cannot be negotiated.
4. The Breeder does not guarantee any specific traits or behaviors in the puppy as it matures.

3. Puppy Selection and Deposit Refund Conditions:

1. Pick Order Guarantee: This Agreement secures _______ place pick from the above-mentioned litter.
2. Conditions for Deposit Refund:
   1. Insufficient Litter Size: If the litter does not produce enough puppies to fulfill the Buyer's guaranteed pick order, the Buyer may either transfer the deposit to the next available litter or request a full refund of the deposit.
   2. Puppy Mortality: If the selected puppy expires or is deemed unfit for sale before delivery, the Buyer may select another puppy from the same litter (if available), transfer the deposit to the next litter, or request a full refund of the deposit.

4. Refund at Breeder's Discretion: Except as outlined in Section 3b, if the Buyer decides against purchasing the puppy for any reason, the Breeder is not obligated to refund the deposit. However, if the Breeder finds an alternative buyer within a reasonable timeframe after the Buyer's withdrawal, the Breeder may, at their discretion, refund the deposit.

5. Final Purchase Price: Breeder and Buyer agree that:

1. The deposit will be credited towards the final purchase price of the puppy.
2. The remaining balance is due before the puppy is shipped or ownership is transferred from Breeder to Buyer. The total purchase price may range from $_________ to $_________, depending on the puppy's sex, color, markings, or other characteristics.
3. The stated purchase price does not cover delivery/shipping charges, optional services (e.g., ear cropping, microchipping), or registration costs.

6. Governing Law: This Agreement and any disputes arising from or related to this Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any choice or conflict of law provision or rule.
